## Abstract

Notice is hereby given that the U.S. International Trade Commission has determined to review a final initial determination ("FID") of the presiding administrative law judge ("ALJ") finding no violation of section 337 in the above-captioned investigation.

## Effects PRIA read

- Commission will review ALJ's 'no violation' finding: mixed, medium. The U.S. International Trade Commission decided to review the administrative law judge's final initial determination (FID) that found no violation in Investigation No. 337-TA-1384. The Commission vote to review the FID took place on March 11, 2025; the ALJ issued the FID on December 19, 2024 and th…
- Possible General Exclusion Order if violation found: cost, high. The ALJ's recommended determination says that if the Commission finds a violation, it should issue a general exclusion order (GEO) under section 337(d)(2)(A). The ALJ recommended the GEO in the RD on remedy dated in the FID (the RD is part of the December 19, 2024 FID).
- ALJ recommended a 0% bond during Presidential review: benefit, medium. The ALJ's recommended determination says that, if the Commission finds a violation, the Commission should set a zero percent (0%) bond for any infringing products imported during the period of Presidential review. This recommendation is part of the RD included in the December 19, 2024 FID.
- ALJ found Optimum no longer a proper complainant: cost, medium. The ALJ found on December 19, 2024 that termination is proper because, due to post-institution assignments of the asserted patents, Optimum Communications Services, Inc. is no longer a proper complainant. That finding was one of the bases for the ALJ's FID finding no violation.
- ALJ found no infringement and domestic industry not shown: benefit, medium. The ALJ's FID (issued December 19, 2024) concluded that Optimum did not prove infringement of the listed claims of U.S. Patent Nos. 7,333,511 and 7,558,260, did not satisfy the importation requirement, and did not meet the technical or economic prongs of the domestic industry requirement for those…
