Congress Cancels EPA Tire Factory Pollution Rules via Review Act

## Summary

The EPA is officially scrapping the 2024 air pollution rules for rubber tire makers because Congress said no. This means the new limits on harmful emissions from rubber tire factories won’t take effect, saving those businesses from new costs and changes—for now. The rule removal kicks in on November 29, 2024, so the old standards stay in place until then.

## Abstract

The U.S. Environmental Protection Agency (EPA) is amending the Code of Federal Regulations (CFR) to remove the provisions finalized by the EPA in a 2024 final rule titled "National Emission Standards for Hazardous Air Pollutants: Rubber Tire Manufacturing" ("2024 Rubber Tire Rule"). Under the Congressional Review Act (CRA), Congress passed, and the President signed, a joint resolution of disapproval of the 2024 Rubber Tire Rule. The 2024 Rubber Tire Rule promulgated first- time air emissions standards for the rubber processing subcategory of the rubber tire manufacturing source category. Under the joint resolution and by operation of the CRA, the 2024 Rubber Tire Rule has no legal force or effect, and the EPA thus is taking this final action to remove the provisions finalized in that rule.

## Effects PRIA read

- 2024 Rubber Tire Rule Revoked: benefit, high. The EPA is removing the 2024 amendments to the National Emission Standards for Hazardous Air Pollutants for rubber tire manufacturing, so the 2024 Rubber Tire Rule has no legal force or effect and the CFR is being revised to remove those provisions. This reversion to the pre-2024 regulatory text (t…
- Rubber Processing Subcategory Left Unregulated: benefit, medium. Under the reinstated subpart (reverting to the 2020 rule), the rubber processing affected source (rubber mixing processes and mixed rubber compound) has no emission limitations or other requirements. That means facilities performing rubber mixing processes are not subject to first-time emission lim…
- Who Is Covered: Major Source Thresholds: mixed, medium. The reinstated NESHAP applies to rubber tire manufacturing facilities that are major sources of hazardous air pollutants, defined as emitting 9.07 megagrams (10 tons) or more per year of any single HAP or 22.68 megagrams (25 tons) or more per year of combined HAP. Facilities below those thresholds…
