## In one line

Renew hazmat permits last-minute—no more 60-day panic rule!

## Summary

Starting September 3, 2026, if you hold a special permit or approval for hazardous materials, you can renew it anytime up to its expiration date—no more 60-day early deadline! This change helps keep your permits active while the agency reviews your renewal, thanks to faster electronic processing. It’s a smoother, smarter way to stay compliant without risking gaps or extra hassle.

## Abstract

This final rule amends the Hazardous Materials Program Procedures to allow an application to renew a special permit or approval to be filed any time on or before its expiration date rather than requiring the renewal application to be filed 60 days in advance as under the current regulations.

## Effects PRIA read

- File Renewals Up To Expiration: benefit, medium. If you hold a special permit or approval, starting September 3, 2026 you may file a renewal application any time on or before the permit's expiration date — the rule removes the prior requirement to file 60 days before expiration. If you file on or before the expiration date and your renewal is com…
- Automatic Timely-Filing Confirmation Letter: benefit, low. When you submit a renewal application through the PHMSA portal you will automatically receive a timely filing letter that verifies your renewal submission and confirms the permit remains timely filed. This verification is intended to reduce confusion about permit validity and to help prevent shipme…
- Operating Under Expired Permits Prohibited: cost, low. The rule clarifies that operation under an expired special permit or approval that was not filed for renewal on or before the expiration date is prohibited (see revised 49 CFR 107.109(b) and 107.705(c)).
- Shipments Loaded Before Expiration May Continue: benefit, medium. If hazardous material is placed into transportation on or before the expiration date of a special permit or approval and the holder timely filed a renewal application, that material may continue in transportation to its destination despite the pending renewal.
- Reduced Regulatory Burden for Permit Holders: benefit, low. PHMSA states this final rule will reduce regulatory burdens and regulatory uncertainty for holders of special permits and approvals and will result in cost savings; PHMSA certifies the rule will not have a significant economic impact on a substantial number of small entities.
