NRC Proposes Updates to Nuclear Reactor Licensing Rules

## Summary

The Nuclear Regulatory Commission is updating rules for nuclear reactor licensing, shutting down old reactors, and keeping an eye on operations to make everything safer and clearer. These changes affect reactor operators and companies involved in decommissioning, with a public comment deadline on November 9, 2026. The updates aim to streamline processes and improve oversight without signaling big cost changes yet.

## Abstract

Consistent with Executive Order 14300, "Ordering the Reform of the Nuclear Regulatory Commission," the NRC is conducting a review and wholesale revision of its regulations. This proposed rule primarily aims to provide regulatory enhancements for reactor licensing, decommissioning, and operational oversight and is one effort in the NRC's activities to address the direction in section 5 of Executive Order 14300.

## Effects PRIA read

- Estimated Net Savings to Industry and NRC: benefit, high. The NRC estimates this proposed rule would produce net averted costs (savings) over the next 30 years of $311 million using a 7% discount rate and $411 million using a 3% discount rate. For industry alone the estimated net averted cost is $305 million (7% NPV) and $398 million (3% NPV); for the NRC…
- Fewer Nonemergency Event Reports Required: mixed, medium. The NRC proposes to eliminate several nonemergency event reporting criteria in 10 CFR 50.72(b), retain a set of key nonemergency reports (including deviations from technical specifications, certain plant shutdowns, reactor protection system actuations, degraded or unanalyzed conditions, and loss of…
- Part 21 Definitions and Submission Updates: benefit, low. The NRC proposes clarifications and revisions to 10 CFR part 21 definitions (including 'dedicating entity,' 'basic component,' 'dedication,' 'commercial grade item,' and 'notification'), would consolidate duplicative regulatory text into part 21, remove 10 CFR part 76 from part 21's scope, and woul…
- Decommissioning Licensing and Trust Fund Changes: benefit, medium. The proposed rule includes changes described as 'Decommissioning Licensing Enhancements' and revisions to 'Financial Qualifications and Decommissioning Trust Fund Use' (applicable to 10 CFR parts 20, 50, 52, and 53). These changes are presented as part of a broader effort to streamline processes an…
