Gaming Commission Trims Tribal Fees and Fingerprint Charges by Four Dollars

## Summary

The National Indian Gaming Commission is lowering the fee rate for tier 2 gaming operations from 0.08% to 0.065%, while tier 1 stays at 0%. Fingerprint processing fees are dropping from $44 to $40 per card. These changes start November 1, 2026, helping tribes save money while keeping the Commission funded and ready to regulate.

## Abstract

Notice is hereby given that the National Indian Gaming Commission (NIGC) has adopted its annual fee rates of 0.00% for tier 1 and 0.065% (.00065) for tier 2. While the rate for tier 1 remains the same, the tier 2 rate has been lowered from 0.08% to 0.065%. The tier 2 annual fee rate represents the lowest fee rate adopted by the NIGC since FY22. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the NIGC. If a tribe has a certificate of self-regulation, the fee rate on Class II revenues shall be 0.0325% (.000325) which is one-half of the annual fee rate. The annual fee rates are effective November 1, 2026, and will remain in effect until new rates are adopted. The NIGC has also adopted its fingerprint processing fee of $40 per card which is $4 lower than the current fee of $44 per card. The fingerprint processing fee is effective November 1, 2026, and will remain in effect until the Commission adopts a new rate.

## Effects PRIA read

- Tier 2 gaming fee lowered to 0.065%: benefit, low. If you operate a Tier 2 tribal gaming operation covered by the NIGC, your annual fee rate is now 0.065% (down from 0.08%). The Tier 1 rate remains 0.00%. These rates apply to all assessable gross revenues and are effective November 1, 2026 until changed.
- Half-rate for self-regulated Class II revenues: benefit, low. If your tribe has a certificate of self-regulation, the fee rate on Class II revenues is one-half of the annual fee rate, i.e., 0.0325% (which is one-half of 0.065%). This rate applies to Class II revenues and is effective November 1, 2026 until changed.
- Fingerprint processing fee cut to $40: benefit, low. Fingerprint processing fees charged by the NIGC are reduced from $44 per card to $40 per card, effective November 1, 2026. This lower fee will apply until the Commission adopts a new rate.
