Credit Unions Get a Clearer Rule for Claiming Members’ Money

## Summary

Federal credit unions can now rely on a clearer rule about their power to claim money owed by members from their accounts. The National Credit Union Administration removed confusing language that didn’t help credit unions figure out their rights. This change takes effect December 4, 2026, making it easier for credit unions to manage debts without legal guesswork.

## Abstract

On February 25, 2026, NCUA (or `agency') published a proposed rule to solicit comments on the removal of a provision of NCUA regulations regarding federal credit unions' (FCUs) statutory lien authority. Upon further consideration, and based on the comments received, the Board is issuing this final rule, as proposed, to remove the term, "except as otherwise provided by law or except as otherwise provided by federal law." This language does not provide any assistance to FCUs in determining whether such statutory or case law exists, therefore it has no material value.
