Credit Union Lending Rules Get a Small Bureaucratic Cleanup

## Summary

The NCUA is updating rules for member business loans by removing an old, unnecessary part to make things simpler and clearer for federally insured credit unions. This change starts November 4, 2026, and helps credit unions follow the rules more easily without extra hassle. Credit unions and their members will benefit from smoother lending processes with no new costs involved.

## Abstract

The NCUA Board (Board) is amending its regulations governing member business loans and commercial lending. This interim final rule eliminates an outdated, transitional provision that is no longer necessary. This action is necessary to reduce regulatory complexity and improve the clarity of the NCUA's regulations. The intended effect is to enhance clarity and simplify compliance for federally insured credit unions (FICUs).

## Effects PRIA read

- Simpler commercial-lending rules for credit unions: benefit, low. The NCUA removed the obsolete transitional provision at 12 CFR 723.9 effective November 4, 2026. The Board says this reduces regulatory complexity and is intended to make it easier for federally insured credit unions (FICUs) to follow commercial-lending rules.
- No new costs for credit unions or members: benefit, low. The Board states the removal of the obsolete provision will not impose new costs and that credit unions and their members will benefit from smoother lending processes with no new costs involved. The Board also requested comments by January 4, 2027.
- Existing grandfathered loans stay unchanged: benefit, low. The Board notes that any outstanding loans that were grandfathered under prior waivers remain grandfathered even after the removal of Sec. 723.9. This status continues after November 4, 2026.
