Tribe Corrects Liquor Ordinance: Vallejo Is a City, Not County

## Summary

The Scotts Valley Band of Pomo Indians fixed three typos in their Liquor Control Ordinance, like correcting the location from Vallejo County to the City of Vallejo in Solano County and clarifying legal terms. These changes keep their rules clear and protect their rights. The updated ordinance kicks in on December 7, 2026, affecting the Tribe and anyone dealing with liquor on their land.

## Abstract

This notice publishes several corrections to the Scotts Valley Band of Pomo Indians of California Liquor Control Ordinance, as amended, published on June 1, 2026. The Tribe requested that the Bureau of Indian Affairs make three corrections to typographical errors it identified in its original Ordinance submission that was previously published in the Federal Register. First, Article I, Section 3 mistakenly identifies the Tribe's trust land as being in "Vallejo County"; the correct geographic description is "the City of Vallejo, Solano County, California." Second, Article I, Section 3(v) incorrectly uses the term "Indian county" instead of the correct statutory term "Indian country" as used in 18 U.S.C. 1154 and 1161. Third, Article VII, Section 1 contains a typographical error referring to "uncontested suits or actions"; the correct phrase is "unconsented suits or actions," accurately reflecting the Tribe's intent to preserve its sovereign immunity.

## Effects PRIA read

- Where and when the Ordinance applies: mixed, low. The ordinance becomes effective on December 7, 2026 and applies to all lands now or in the future under the Tribe's control, including approximately 160 acres of Tribal Trust Land located in the City of Vallejo, Solano County, California (accepted into trust on January 10, 2025). - Alcohol sales and manufacture allowed with rules: benefit, medium. Sales are permitted at tribally owned enterprises, enterprises leased from the Tribe, and tribally approved sp…
- Tribal licensing requirement and standards: cost, medium. The Tribal Council can require and issue tribal liquor licenses, set a license fee schedule, and publish standards; no tribal license will be issued except upon showing satisfactory proof of a State license. The Tribe may set standards that are as strict or stricter than the State.
- Age limit matches State (21 years): cost, low. The legal age for possession or consumption of alcohol on Tribal Trust Lands is the same as State law, currently 21 years. No person under 21 may purchase, possess, or consume alcoholic beverages on those lands except as permitted by State law.
- Tribal enforcement powers and penalties: cost, low. Tribal law enforcement and authorized security may enforce the Ordinance, including confiscating liquor sold or possessed in violation, and the Tribal Council may impose civil and criminal penalties, suspend or revoke tribal licenses, and hold hearings on violations. Enforcement is to be consistent…
- Tribe may tax liquor sales or consumption: cost, medium. The Tribe expressly retains the right to impose taxes on the sale or consumption of liquor by appropriate ordinance to the fullest extent permitted by Federal law. The Ordinance does not limit or restrict the Tribe's ability to impose such taxes.
- Sovereign immunity explicitly preserved: cost, low. The Ordinance states that nothing in it waives the Tribe's sovereign immunity; the Tribe and its officers, entities, and agents retain immunity from "unconsented suits or actions" of any kind. If you want to bring a suit against the Tribe or its officials, the Ordinance preserves the Tribe's immuni…
