FDA classifies orthopedic wearable that vibrates its way into regulation

## Summary

The FDA has officially placed wearable vibration devices for orthopedic use into Class II, meaning they now have special safety rules but face fewer regulatory hurdles. This change helps patients get access to these innovative devices faster while keeping safety in check. The new classification took effect on November 5, 2026, but has been in place since January 12, 2024, making it easier and potentially cheaper for makers to bring these devices to market.

## Abstract

The Food and Drug Administration (FDA) is classifying the wearable vibration device for orthopedic use into class II (special controls). The special controls that apply to the device type are identified in this order and will be part of the codified language for classification of the wearable vibration device for orthopedic use. We are taking this action because we have determined that classifying the device into class II will provide a reasonable assurance of the safety and effectiveness of the device. We believe this action will also enhance patients' access to beneficial innovative devices, in part by reducing regulatory burdens.

## Effects PRIA read

- Wearable orthopedic vibration devices reclassified: benefit, medium. The FDA has classified wearable vibration devices for orthopedic use as Class II (special controls). This order is effective November 5, 2026, and the classification has been applicable since January 12, 2024; FDA says the change reduces regulatory burdens and will enhance patients' access to these…
- De Novo creates predicate for future devices: benefit, medium. Because FDA granted De Novo classification for this device type, the wearable vibration device can serve as a predicate for future devices. That means other device sponsors can use the less-burdensome 510(k) pathway rather than a premarket approval application when marketing substantially equivalen…
- Device remains subject to 510(k) premarket notification: cost, medium. The FDA states that wearable vibration devices for orthopedic use are subject to premarket notification under section 510(k) of the FD&C Act, and FDA has not determined that this device type should be exempt under section 510(m). Manufacturers must therefore submit a 510(k) unless and until an exem…
- New special controls require safety and labeling tests: benefit, medium. The final order establishes special controls that require clinical performance testing (including at least 1 year of follow-up), non-clinical performance testing (device output characterization and validation that vibration is within safe physiologic limits), biocompatibility, electrical/mechanical…
