Legal Aid Grants Get a New Definition for Building Upgrades

## Summary

The Legal Services Corporation is updating its rules about what counts as a 'capital improvement' on buildings by removing the minimum spending amount. This change helps track and manage funds better and makes sure money is used responsibly. If you get LSC grants, watch out—comments on this update are due by December 21, 2026.

## Abstract

This proposed rule revises the Legal Services Corporation's (LSC) definition of "capital improvement" by removing the threshold amount of LSC funds that must be expended on an improvement to real estate for the expenditure to qualify as a capital improvement. The proposed amendment would distinguish the definition of a capital improvement from the monetary thresholds required for prior approval; promote consistent tracking and oversight of LSC funds used for capital improvements; and strengthen accountability for LSC funds invested in recipients' real property.

## Effects PRIA read

- Any LSC-funded Property Work Is a Capital Improvement: cost, low. If you receive Legal Services Corporation (LSC) grant funds, any amount you spend of LSC funds to improve real estate—through construction or adding fixtures—will now count as a "capital improvement." The current $50,000 monetary threshold is removed, so even small or repeated expenditures must be…
- Prior Approval Thresholds Stay Separate: benefit, low. The rule removes the dollar amount from the definition of "capital improvement" but does not change prior approval rules. The separate prior approval threshold (recently raised to $50,000 in related provisions) remains in place, so you will not automatically need LSC prior approval for every capita…
- Must Account for Cumulative LSC Real Property Investment: cost, low. LSC requires recipients to identify and account for LSC funds used for capital improvements regardless of the amount. This aligns the definition with Sec. 1631.15(c), which requires maintaining documentation sufficient to identify and account for any use of LSC funds on recipient-owned real estate.
