FDA Classifies a Mechanical Device That Helps Clear Congestion

## Summary

The FDA is officially classifying the external mechanical stimulator for congestion relief as a Class II device, meaning it now has special safety rules but fewer regulatory hurdles. This change helps patients get access to these devices faster and ensures they’re safe and effective. The new classification took effect on November 6, 2026, with the rules applying retroactively from December 4, 2023.

## Abstract

The Food and Drug Administration (FDA) is classifying the external mechanical stimulator for the relief of congestion into class II (special controls). The special controls that apply to the device type are identified in this order and will be part of the codified language for classification of the external mechanical stimulator for the relief of congestion. We are taking this action because we have determined that classifying the device into class II will provide a reasonable assurance of the safety and effectiveness of the device. We believe this action will also enhance patients' access to beneficial innovative devices, in part by reducing regulatory burdens.

## Effects PRIA read

- Device now Class II — faster access: benefit, medium. The FDA officially classified the external mechanical stimulator for relief of congestion as Class II (special controls). The order is effective November 6, 2026, and the classification was applicable on December 4, 2023; FDA says this classification provides a reasonable assurance of safety and wi…
- Device subject to 510(k) premarket notification: cost, medium. Because the device is classified into Class II, it is subject to premarket notification under section 510(k) of the Federal Food, Drug, and Cosmetic Act unless FDA exempts it. The final order states FDA has not determined an exemption for external mechanical stimulators for relief of congestion, so…
- Mandatory safety, testing, and labeling rules: benefit, low. The final order lists special controls manufacturers must meet, including non-clinical performance testing, electromagnetic compatibility, battery and electrical safety testing, software verification/validation and hazard analysis, biocompatibility evaluation of patient-contacting parts, human fact…
- De Novo classification creates predicate for others: benefit, medium. FDA states that because this device was classified via the De Novo process, it can serve as a predicate device for future devices of the same type, allowing other sponsors to use the less burdensome 510(k) process rather than a De Novo request or premarket approval. That change can reduce regulator…
