## Summary

**Expands Qualified Opportunity Zone eligibility to include census tracts that contain portions of former Department of Defense installations closed under BRAC.** The bill adds a new tract category to section 1400Z-1 and creates a special rule that affects how those tracts count toward state designation limits. - Communities with former BRAC military sites become a new category eligible for nomination as Qualified Opportunity Zones under section 1400Z-1(c)(1)(C). Tracts that do not meet the existing low-income tests will not be treated as low-income communities under the added rule. - States may increase the number of tracts they designate by the number of BRAC tracts they nominate during the applicable designation period. This effectively expands the pool of tracts available for designation beyond current limits. - The amendments apply only to areas designated under section 1400Z-1 after the date of enactment.

If enacted, this bill would provide that a census tract containing a former Department of Defense installation closed in a BRAC round that does not meet the existing subparagraph (A) or (B) tests would not be treated as a low-income community for Opportunity Zone rules. That would stop investors an…
