## Summary

**This bill would require written partnership agreements between delivery platforms and restaurants before platforms can list or accept orders.** It would also give the Federal Trade Commission authority to write and enforce those rules and make the FTC's rule on impersonation of government and businesses legally binding. - Restaurants: Platforms would need a signed written agreement to place orders or facilitate delivery for a restaurant. If a restaurant requests removal and no agreement exists the platform must remove the listing and stop taking orders within 10 days. - Delivery platforms: Any online service that lets consumers order from restaurants that are not the platform itself and that facilitates delivery must secure partnership agreements or cease order facilitation for nonpartner restaurants. The requirement would apply to orders placed on or after 180 days after enactment. - Federal enforcement and rulemaking: The FTC would get explicit authority to issue regulations to implement the partnership and removal rules. Violations would be enforced under the FTC Act and the bill makes the FTC's impersonation rule legally binding.

## Provisions PRIA read

- FTC impersonation rule becomes binding: benefit, low. If enacted, the bill would give the FTC's final "Trade Regulation Rule on Impersonation of Government and Businesses" (89 Fed. Reg. 15017, March 1, 2024) the force and effect of law upon enactment. That would make the FTC rule legally binding rather than advisory. The bill does not add new payments…
- New delivery platform rules for restaurants: mixed, medium. If enacted, the bill would bar a delivery platform from taking or facilitating orders for a restaurant unless the platform has a written partnership agreement with that restaurant. If a restaurant without such a written agreement asks to be removed, the platform would have to remove the restaurant…
