## Summary

**Would stop safety-net providers from paying more than the 340B ceiling price at the point of purchase.** The bill would add an upfront pricing rule to the 340B statute and require the HHS Secretary to account for that limit when evaluating manufacturer agreements. - Safety-net covered entities named in 340B(a)(4), entities that receive funds directly from a state or local government, and sole community hospitals would be protected from upfront overpayments. - Drug manufacturers would be barred from making agreements that charge those safety-net entities above the applicable 340B ceiling price at purchase, even if later rebates or reconciliations would occur. - The HHS Secretary would be required to apply the new upfront pricing constraint when determining whether existing agreements with manufacturers meet 340B requirements.
