## Summary

**Replace absolute liability with comparative negligence** for elevation- and gravity-related injuries on infrastructure or transportation projects that get federal funding, tax incentives, or federal permits. The bill would set a federal rule for how fault is measured and who can sue, and it defines covered projects, workers, and risks. - Workers: People who supervise or perform work on covered projects would face negligence-based claims for elevation or gravity hazards instead of automatic employer liability. Workers' compensation laws are not affected. - Contractors and property owners: Contractors and property owners on projects that accept federal financial assistance, tax incentives, or permits would no longer be subject to state absolute liability for elevation-related injuries. Fault would be apportioned under comparative negligence instead. - States and courts: States would be barred from enforcing absolute-liability rules for covered projects and would be required to apply comparative negligence. Claims tied to these projects would be heard only in federal courts, and the rule would apply to projects accepting federal assistance on or after Jan. 1, 2026.
