## Summary

**Would allow the Merchandise Processing Fee (MPF) to fund CBP capital costs at sea ports of entry.** It would also bar ports from providing administrative, training, or recreational facilities for CBP inspections and require annual CBP reports on MPF proceeds and outstanding capital needs. - Gives CBP authority to include capital costs in the MPF fee structure and adds capital for passenger inspection services as an authorized use. The amendments would take effect 180 days after enactment. - Stops requiring or requesting sea ports of entry to provide or maintain administrative, training, or recreational facilities for CBP inspection services. This does not change Department of Homeland Security authority under the Homeland Security Act. - Expresses a bipartisan sense that the Secretary of the Treasury and the CBP Commissioner should jointly calibrate the MPF level so CBP can fund equipment upgrades and facility work. - Requires CBP to report annually, beginning within one year, the total MPF proceeds collected, the portion directed to sea-port inspection facilities, and outstanding capital needs. Reports must go to the specified House and Senate committees.
