## Summary

**Gives transit agencies new flexibility to spend urbanized area formula grants on operating costs of equipment and facilities used in public transportation.** It also adds an annual maintenance-of-effort certification and a clear penalty for noncompliance. - Transit agencies and other recipients may use Section 5307 urbanized area formula grant funds to pay operating costs of equipment and facilities used in public transportation. - A recipient must, by the 30th day of the first full fiscal year after first receiving these funds and each fiscal year thereafter, submit a certification that it will maintain effort for any operating costs covered by the grant. - If a review finds a recipient failed to maintain effort during a fiscal year, the Secretary must reduce that recipient's next fiscal year Section 5307 grant by one-third.

The first is due by the 30th day of the first full fiscal year after first getting funds, and then each year. The pledge must say they will maintain effort for those operating costs. If the Secretary finds they fa…
