## Summary

**U.S. constitutional rights would take precedence over foreign or religious law in American courts.** The No Shari'a Act would bar courts and arbitration panels from applying Shari'a or other foreign law when doing so would infringe constitutional "fundamental rights". - Families: In marriage, divorce, child custody, adoption, and inheritance cases, courts could not apply foreign or religious law that conflicts with due process, equal protection, freedom of religion, freedom of speech, or state constitutional rights. - Contracts and judgments: Courts would be prohibited from enforcing judgments, decrees, or arbitration decisions that rely on Shari'a or other foreign law if doing so would violate constitutional rights. Choice-of-law clauses naming foreign law would remain valid unless enforcement would breach those rights. - Implementation and scope: The bill would define "foreign law", "court", and "fundamental rights", require the Attorney General to issue regulations and provide judicial education with the Administrative Office of the U.S. Courts, include a severability clause, and take effect 180 days after enactment.

- No foreign law in family cases: benefit, medium. If enacted, courts would not apply or enforce foreign or religious law in key family cases. This includes marriage, divorce, child custody, adoption, and inheritance. Courts would also reject judgments or arbitration awards that rely on Shari'a or foreign law if rights would be violated.
- Effective 180 days after enactment: mixed, high. If enacted, all of the bill's rules would start 180 days after it is signed. Courts, agencies, and parties would follow the new rules after that date.
- Definitions and court training for new rules: mixed, medium. If enacted, the bill would define 'foreign law,' 'court,' and 'fundamental rights' for these rules. Fundamental rights include due process, equal protection, religion, speech, marriage, custody, and property. The Attorney General, with the courts' administrative office, would issue rules and train…
- Contracts choosing foreign law face limits: mixed, low. If enacted, contracts that choose a foreign law would generally remain valid. Courts could refuse to enforce that choice if it would violate constitutional rights. This would affect people and businesses using cross-border contracts.
