## Summary

**Would create a 120-day deadline that lets federal employees and applicants take stalled Merit Systems Protection Board appeals to federal district court.** It would also set where suits can be filed and the standards courts must use when reviewing those cases. - Employees and applicants: After 120 days from filing an MSPB appeal, they would be able to file a civil action in a federal district court instead of waiting indefinitely. - Venue rules: Suits could be filed where the personnel action occurred or where the person would have worked. If those districts lack personal jurisdiction over the respondent the suit could be filed where the respondent's principal office is located. - How courts review: Courts would apply the 5 U.S.C. 7703(c) standard only to MSPB orders. For other determinations courts would use the same standard MSPB would have applied to the personnel action. - MSPB process: Filing a district court action would stay the MSPB appeal. If the district court dismisses for lack of jurisdiction MSPB must resume processing the appeal.
