## Summary

**This bill creates a new national security waiver that lets the President override air emissions offset requirements for certain advanced manufacturing and critical mineral facilities.** It also lets states accept alternative offset measures or charge an emissions fee up to 1.5 times recent local control costs to drive local emissions reductions. - Operators of semiconductor plants and facilities that extract or process critical minerals can apply for a presidential waiver to avoid part or all offset requirements. The President must make the waiver decision personally and cannot delegate it. - State permitting authorities must allow alternative or innovative offset measures when a source shows offsets are unavailable. They may instead impose an emissions fee up to 1.5 times the area's average cost of stationary source control measures from the prior three years and must use fees to maximize local emissions reductions. - The waiver and alternative-offset rules apply only to facilities primarily making semiconductors or semiconductor equipment and to facilities primarily engaged in extracting, processing, refining, or milling critical minerals as designated by the Secretary of the Interior.

If enacted, this bill would change air permitting for certain new or modified large semiconductor and critical mineral facilities. States would let these facilities use alternative offsets if they show all reasonable and available offsets are used. States could require another pollution-cutting mea…
