## Summary

**Removes federal immunity for makers and sellers of glyphosate-based herbicides and elemental phosphorus.** This bill would let people harmed by exposure sue manufacturers, distributors, formulators, suppliers, and sellers in U.S. district court and bar immunity defenses tied to the Defense Production Act or federal contractor status. - Families and exposed individuals would be able to seek compensatory and punitive damages, equitable relief, and attorney fees for injuries or wrongful death. Claims arising before, on, or after enactment are covered and pending suits are preserved. - Covered entities — including manufacturers, distributors, formulators, suppliers, and sellers — would face private federal lawsuits and could not claim immunity under the Defense Production Act or the Federal Contractor Defense. Actions may proceed in federal court without regard to amount in controversy or citizenship. - The bill would bar use of Federal funds to implement, administer, or enforce the February 18, 2026 Executive Order titled "Promoting the National Defense by Ensuring an Adequate Supply of Elemental Phosphorus and Glyphosate-Based Herbicides."
