## Summary

**This bill would give the Food and Drug Administration (FDA) authority to conduct microbial sampling at concentrated animal feeding operations (CAFOs) during foodborne illness outbreaks and other public health needs.** It sets rules for reasonable access, requires data sharing with USDA and public health agencies, and makes refusal to allow sampling an unlawful act under the Federal Food, Drug, and Cosmetic Act. - Farmers and CAFO operators: Must provide reasonable access for FDA sampling of plants, animals, water, and the surrounding environment. Refusing reasonable access is made an unlawful act and FDA may set reasonable time, place, and manner conditions so long as they do not prevent timely sampling. - Public health agencies and consumers: FDA sampling aims to help detect outbreaks, find root causes, and support outbreak investigations. Data collected must be shared with the Secretary of Agriculture and relevant State and Federal public health agencies to aid prevention and response. - USDA-regulated producers: The bill clarifies it does not impose additional requirements beyond microbial sampling for foods under the Federal Meat Inspection Act, the Poultry Products Inspection Act, or the Egg Products Inspection Act. *The bill does not authorize new federal funding and does not include new appropriations.*

This could happen when needed to investigate or stop a foodborne illness, find its root cause, or meet other public health needs. These operations would have to give reasonable access to sample…
