## Summary

**Funding Cap Waiver Authority** would let McKinney‑Vento grantees request waivers to exceed the section 415(b) spending limits for fiscal years 2027–2030. The bill would require public notice, HUD posting, a 60 day decision window, and it would bar approvals when a grantee relocates people without offering shelter or other housing options. - Recipients could request waivers by showing local need, submitting a detailed plan for how funds will be used, and proving the proposed uses align with their most recent Consolidated Plan. An approved waiver would remain in effect for the grant's period of performance for FY2027–2030 unless the recipient revokes it. - Recipients must notify all subrecipients and Continuums of Care in their area and solicit public input before submitting a waiver request. If a recipient seeks to revoke a waiver it must solicit input from subrecipients and provide a summary and justification to them and to HUD before revoking. - The Department of Housing and Urban Development must publish all waiver requests online and approve or deny each request within 60 days of receipt. - HUD must deny any waiver request from a recipient that relocates or threatens to relocate individuals or their property without providing emergency shelter, rapid rehousing, transitional housing, permanent supportive housing, or other permanent housing options.
