## Summary

**Treats certain recovered materials used in cement as not 'solid waste'.** This bill would change the Solid Waste Disposal Act to add new non-waste categories and tie those categories to legitimacy rules in 40 CFR Part 241 and to generator control. - Cement manufacturers would be able to use more non-hazardous secondary materials or recovered resources as ingredients or fuels in cement or clinker production if those materials meet the specified legitimacy criteria and are managed as valuable commodities. - Generators of recovered materials would need to keep materials under their control and manage them as valuable commodities to qualify for the non-waste treatment described in the bill. - Environmental regulators would determine non-waste status by referencing Part 241 of Title 40, Code of Federal Regulations as in effect on the date of enactment, shifting which recovered materials are treated as waste for regulatory purposes.
