## Summary

**Transfer of child care access functions to the Department of Health and Human Services.** This bill would move the Department of Education functions under section 419N of the Higher Education Act that support child care access for low-income postsecondary students into HHS and allow HHS to exercise related authorities that ED held. - Low-income parents enrolled in postsecondary education would have their child care access program overseen by the Department of Health and Human Services instead of the Department of Education. - Federal personnel, contracts, records, property, liabilities, and unexpended balances tied to the transferred functions would move to HHS, with unspent funds required to be used for their original purposes. - The Office of Management and Budget would enforce a no-net-increase rule for federal full-time equivalents, manage incidental transfers, and certify compliance to congressional committees. Ongoing grant applications, lawsuits, and administrative reviews tied to the functions would continue with appropriate substitutions, and ED resources may be used during a reasonable transition period.
