## Summary

**Exempts certain affordable-housing rehabilitation bonds from the federal volume cap.** The bill would let issuing authorities elect to remove specific exempt facility bonds from their volume caps when most bond proceeds fund preservation, improvement, or replacement of eligible low-income or federally or state-assisted rental buildings. - Would support preserving and improving affordable rental buildings, including those whose low-income tax credit compliance period has closed but still have an unexpired extended use period. This targets projects focused on keeping eligible housing in service for low-income tenants. - Would let issuing authorities elect to exempt these bonds from their volume caps if 95% or more of net proceeds fund eligible activities. For bonds covered by an election, the limit on acquiring existing property is raised to 50%, the election is irrevocable, and the change would apply to bonds issued after enactment. - Changes low-income housing tax credit rules so such exempt bonds do not count against LIHTC-related limits when states determine eligibility or make allocations.
