## Summary

**Limits how many patents a biologic drug maker can assert against a biosimilar applicant.** The bill would cap certain patent assertions in biosimilar litigation while also expanding the kinds of patents that can be claimed to include manufacturing-method and manufacturing-product patents. - If a biosimilar applicant completes the information-sharing steps under the FDA biosimilar pathway, the reference product sponsor may assert up to 20 patents in an infringement suit and no more than 10 of those may have issued after a specified date. - Only patents that are listed and that either were filed more than four years after the reference product’s approval or claim a manufacturing-process method not used by the reference sponsor count toward the cap, narrowing some late-filed patent claims. - Courts can increase the cap for the interest of justice or for good cause and may consider whether the reference sponsor gave a reasonable description of extra information needed to support additional infringement claims.
