## Summary

**This bill would redefine hemp to include plants and products with up to 1 percent delta-9 THC.** It also tightens testing accuracy and forces specific transport paperwork for hemp shipments. - Farmers and hemp product makers: They could grow and sell plants and derivatives that contain up to 1 percent delta-9 THC, expanding what qualifies as hemp. - Transporters and testing labs: Shipments must carry either a state, Tribal, or Secretary-issued producer license or a lab certificate showing delta-9 THC at or below 1 percent. Labs must use methods with measurement uncertainty no greater than 0.075 percent. - State, Tribal, and federal regulators: Plans and cross-references would be updated to the new 1 percent threshold and to include the new transport rules. The Secretary of Agriculture must revise Part 990 of Title 7 within 90 days and may do so without the usual notice-and-comment process.

## Provisions PRIA read

- Higher THC limit for hemp: benefit, medium. If enacted, the legal delta-9 THC limit that defines hemp would rise to 1.0 percent on a dry weight basis. This change would apply immediately in the named hemp provisions and reduce the chance a hemp crop is treated as illegal. Hemp growers, processors, transporters, retailers, and State and Triba…
- New paperwork for hemp shipments: cost, low. If enacted, anyone transporting hemp would need to keep with the shipment either (A) a copy of a valid State or Tribal license or a Secretary-issued producer license, or (B) a laboratory certificate showing delta-9 THC of not more than 1 percent on a dry weight basis. Carriers, producers, State and…
- Stricter hemp product testing rules: cost, low. If enacted, testing under USDA, State, and Tribal hemp plans would need methods with a measurement-of-uncertainty no greater than 0.075 percent for delta-9 THC. The bill would also change the cited wording from "hemp" to "products derived from hemp plants" in the testing clauses. Testing laboratori…
- USDA must update hemp rules: mixed, low. If enacted, the Secretary of Agriculture would be required to revise 7 CFR part 990 within 90 days to reflect the new hemp definition, testing uncertainty standard, and transport documentation rules. USDA could make those regulatory changes without the usual public notice-and-comment process, speed…
