## Summary

**An "approved vendor" regime** would be created under the PROTECT Our Children Act to let vetted cloud providers store and serve child pornography, intimate depictions of minors, and related imagery for law enforcement while setting liability limits and strict security and data rules. - Cloud providers that meet security rules and contract with a covered agency can qualify as an approved vendor and receive narrow civil and criminal immunity for carrying out the contract, except for intentional or negligent misconduct showing malice or reckless disregard. Vendors must file a notice with the Department of Justice within 30 days of contracting and undergo an independent annual cybersecurity audit. - Covered agencies must keep evidence following FBI Criminal Justice Information Services policy or applicable law and generally must keep stored imagery in the United States unless the agency expressly approves an overseas transfer for investigative purposes. Retention must cover applicable statutes of limitation or sentence durations. - Approved vendors must use end-to-end encryption or equivalent, follow the NIST Cybersecurity Framework and NIST SP 800-53, Rev. 5 standards, minimize access, preserve integrity for transfer, and notify DOJ or the relevant state attorney general within 30 days of specified contract breaches.
