## Summary

**Would exempt Defense Department determinations that identify Chinese military companies from the Administrative Procedure Act’s notice-and-comment and judicial-review requirements.** It inserts a new subsection into Section 1260H that treats a Secretary of Defense determination under that section as a military or foreign affairs function for purposes of 5 U.S.C. 554 and related APA provisions, thereby removing those APA procedures and judicial review from the identification process.
