## Summary

**Annual fraud checks on advance premium tax credit determinations under the Affordable Care Act.** This bill would require the Department of Health and Human Services, in coordination with the Department of the Treasury, to prepare a fraud risk assessment that documents controls used to prevent improper advance premium tax credit claims. - Federal agencies: HHS, working with Treasury, would prepare the assessment and list any controls used to prevent fraud in advance premium tax credit claims. The initial assessment is due by December 31, 2025 and then must be updated annually. - Oversight recipients: Each assessment must be submitted to the HHS Inspector General and to specified congressional committees. Those committees include the Senate Finance Committee, the Senate Budget Committee, the Senate Health, Education, Labor, and Pensions Committee, and the House Ways and Means, House Budget, and House Energy and Commerce Committees. - Method and scope: Assessments must follow the Comptroller General's July 2015 fraud risk framework and cover advance determinations under ACA section 1412 and premium tax credits under Internal Revenue Code section 36B.
