## Summary

**Would expand the definition of aggravated felony to cover intoxicated driving that causes death or serious bodily injury.** The bill would add a new subparagraph to Section 101(a)(43) of the Immigration and Nationality Act to cover driving while intoxicated, impaired, or under the influence of alcohol, a controlled substance, or any other intoxicating substance when the offense results in death or serious bodily injury. A conviction would count for immigration purposes whether it is labeled a misdemeanor or felony under federal, state, tribal, or local law, and that aggravated-felony designation would enable enhanced immigration enforcement and potential removal actions against noncitizens with such convictions.
