## Summary

**Bars the VA from sending veterans' personally identifying information to the federal background-check system just because a VA-appointed fiduciary manages their benefits.** It allows such sharing only if a judge or other judicial authority finds the veteran or beneficiary is a danger to themselves or others. - Veterans and beneficiaries: People with VA-appointed fiduciaries will not have their personal data sent to the National Instant Criminal Background Check System solely for that reason. Only a judicial finding of danger triggers a VA report. - Department of Veterans Affairs and fiduciary payments: The VA is prohibited from transmitting beneficiary personally identifiable information to the Department of Justice for NICS when the VA determines to pay benefits to a fiduciary under chapter 55 of title 38, unless there is a judicial order or finding. - Department of Justice and NICS: The DOJ will not receive VA-originated PII for use by NICS in these fiduciary cases unless a competent judicial authority has found the person dangerous.
