## Summary

**Mandatory detention for certain theft-related offenses.** The law requires the Department of Homeland Security to detain non-U.S. nationals who are unlawfully present or lack proper admission documents and who are charged with, arrested for, convicted of, or admit to burglary, theft, larceny, or shoplifting. - Non-U.S. nationals: Individuals charged with those offenses can be held, designated as inadmissible when seeking admission, and are subject to a DHS detainer. If not already detained by federal, state, or local officials, DHS must effectively and expeditiously take custody. - States: State attorneys general and other authorized state officers may sue the Secretary of Homeland Security in federal court for injunctive relief when a federal decision or alleged failure causes harm to the state or its residents, including financial harm over $100, and such suits can receive expedited docketing where harm exists. - Federal enforcement and courts: The law codifies a DHS detainer mechanism, emphasizes DHS authority over parole and detention language, and creates a limited set of exceptions governing when injunctive relief is available to states.
