## Summary

Expands the types of electronic devices subject to the Electronic Device Recycling and Recovery Act to include electronic device peripherals and certain legacy devices. Excludes manufacturers of only electronic device peripherals and no other electronic devices. Allows, rather than requires, the Department of Health to determine additional penalties. Requires manufacturers' recycling plans to describe communication efforts with the State and counties to facilitate consumer education efforts. Repeals the requirement that recycling plans be implemented and fully operational by 1/1/2023 in order for manufacturer collaboration authority to apply. Establishes additional manufacturer recycling goals beginning on 1/1/2026 and 1/1/2027. Requires additional information to be included in manufacturers' reports containing information for calendar years 2025, 2026, and 2027. Requires collectors to report certain information regarding recyclers and refurbishers and allows the Department of Health to require submission of bills of lading and recycler receiving reports. Requires a report to the Legislature. (CD1)

## Bill overview: provisions PRIA read

- More electronics enter Hawaii recycling: benefit, low. Beginning July 1, 2025, Hawaii’s recycling program covers more electronics. These include fax machines, VCRs, DVD players and recorders, home routers and modems, and certain portable music players. It also covers devices with screens larger than four inches and listed items such as keyboards, mice,…
- Electronics collectors must report shipments: cost, low. Collectors must report each year how much they collected for recycling and reuse. They must name the recyclers and refurbishers they used and report the weight sent to recyclers and the number and weight of devices reused. Reports were due by March 31, 2024, and are due annually after that. The Dep…
- Free electronics drop-off with pickup fees: mixed, low. Manufacturers must put approved recycling plans into action and coordinate with the State and counties on public education. Plans must offer convenient, no-cost collection at least monthly in a county or ZIP area with more than 25,000 people. They must provide staffed drop-off, another collection s…
- Electronics makers face stronger recycling rules: mixed, low. Manufacturers’ minimum recycling targets by weight were 50% in 2023 and 60% in 2024. They rise to 63% in 2025, 66% in 2026, and 70% in 2027; each target is based on Hawaii sales from two years earlier. Plans must use registered collectors and recyclers with R2, e-Stewards, or equivalent certificati…
- More electronics sellers count as makers: mixed, low. The law treats brand owners, sellers using a brand, unbranded makers, and importers of foreign-made devices as manufacturers under the recycling program. A person is exempt if they sold fewer than 100 electronic devices in Hawaii during the prior calendar year. A person who makes only electronic-de…
