## Bill overview: provisions PRIA read

- Visitors no longer need written permission: benefit, low. People without Hansen’s disease no longer need written permission under this law to visit or stay on covered lands. The law also removes the related fine of $10 to $100.
- Continued care for Hansen’s disease: benefit, low. Hawaii’s health department must provide needed care and treatment for people with Hansen’s disease. It must seek a cure and provide care consistent with accepted medical practice. The law removes language allowing compulsory isolation and treatment.
- Patient workers lose pay and pension protections: cost, high. Patient employees at Hansen’s disease care facilities lose the stated minimum-wage floor and paid sick and vacation leave. Patient employees or laborers also lose the stated pension entitlement after 20 or more years of health department service. The law removes a patient hiring authority and a hir…
- Kalaupapa residents lose residence protections: cost, medium. Patient residents lose the stated guarantee that they can remain at Kalaupapa for as long as they choose, even after successful treatment. A non-patient spouse also loses the stated right to live there when the patient asks. The law removes a direction for the health department to protect residents…
- Kalaupapa store loses funding and price rules: cost, low. The law ends the requirement for state general fund money for the Kalaupapa store and the health department’s related budget request. The store is also no longer barred by this law from charging more than merchandise costs. The law does not state an amount, set new prices, or say whether other fund…
- Patients lose care and transfer protections: cost, low. Patients at Hale Mohalu and Kalaupapa lose a rule calling for care and privileges to be as equal as practicable. People at Kalaupapa also lose the stated option to request a move to Hale Mohalu or return. The law does not state what standards or transfer process replace these rules.
- New fishing rules near Kalawao: mixed, low. Patients fishing along Kalawao’s shorelines or in nearby waters must follow state fishing laws. The law also removes the specific ban on selling their catch outside Kalawao.
- Kalawao becomes part of Maui County: mixed, low. Kalaupapa, Kalawao, and Waikolu become part of Maui County instead of forming a county on their own. The health department director’s rulemaking authority no longer includes full governance of Kalawao, but still covers Hansen’s disease care and related services. The law does not specify a direct ch…
