## Summary

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Makes changes in provisions concerning definitions; oaths, subpoenas, and penalties; applicants with criminal convictions; qualification for licensure or registration; health care worker licensure actions; automatic suspension of a health care worker's license; the publication of disciplinary actions; and records of Department actions. Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. In provisions concerning required licensure, provides that an application shall not be automatically placed on hold, delayed, denied, or otherwise not processed by the Department of Financial and Professional Regulation because it was submitted by a person who is incarcerated. Amends the Health Care Professional Credentials Data Collection Act. In provisions concerning licensure records, provides that licensure records designated confidential and considered sealed (rather than expunged) for reporting purposes by the licensee are not reportable under the Act. Amends the Unified Code of Corrections. In provisions concerning loss and restoration of rights, provides that no application for specific licenses granted under the authority of the State shall be denied to (rather than denied by reason of) an eligible offender who has obtained a certificate of relief from disabilities, having been previously convicted of one or more criminal offenses (rather than or by reason of a finding of lack of "good moral character"), when the finding is solely based upon the fact that the applicant has previously been convicted of one or more criminal offenses, except for certain circumstances. Repeals provisions concerning the Department of Financial and Professional Regulation's annual report to the General Assembly. Makes other changes. Effective immediately.

## Bill overview: provisions PRIA read

- Fairer license reviews for workers: benefit, high. When a past conviction may affect a license, the Department must review factors such as the offense, its connection to the work, rehabilitation, and public safety. It considers whether 5 years have passed since a felony conviction or 3 years since release from confinement, whichever is later, witho…
- Health workers face fraud, chaperone rules: cost, high. A licensed health care worker’s license is automatically and indefinitely suspended after a qualifying health care or insurance fraud conviction or plea, including Medicare or Medicaid fraud. A hearing can address only how long the suspension lasts, not the conviction. For these licensing actions,…
- Finishing a sentence no longer restores licenses: cost, medium. People whose state-issued license rights were suspended or revoked because of a conviction no longer regain them automatically just by completing imprisonment or being discharged from probation, conditional discharge, or periodic imprisonment. The removed rule did not apply to motor vehicle license…
- Certificates open doors, require proof: mixed, medium. Eligible people can seek certificates of relief for more professional licenses, including licenses overseen by the Department’s professional and real estate divisions. A certificate can limit conviction-based denials, but agencies can still deny a license for a direct connection between the offense…
- License discipline records can be sealed: mixed, medium. Eligible licensees can apply to make qualifying discipline records confidential for a nonrefundable $175 fee. They must apply more than 3 years after the offense or license restoration, whichever is later, and have no later discipline, pending investigation, or current disciplinary status. The Depa…
- New enforcement powers for licensing cases: mixed, low. The Department can require relevant testimony and materials during investigations or hearings under laws it administers. It can also take action when a professional’s conduct harms or threatens harm to the public, after considering the required conviction-related factors. Hearing witnesses receive…
