## Bill overview: provisions PRIA read

- Two state filing charges are removed: benefit, low. The law removes the secretary of state’s listed 50-cent-per-page fee for copies of laws, resolutions, records, and other filed documents. It also removes the $5 fee for filing a certificate of appointment of attorney. These changes remove those specific charges, not every possible records fee.
- Employer service firms submit fewer identifiers: benefit, low. Professional employer organizations applying for a North Dakota license no longer have to provide their taxpayer or employer identification number. This removes one application requirement. It does not change who qualifies for a license.
- Misleading business names face cancellation: benefit, low. The secretary of state can cancel a trade name registration when an important fact was misrepresented. Before cancellation, the office must give at least 30 days’ notice to the registrant and any possibly misrepresented parties. Notice goes to an address or electronic address on file.
- More state transactions carry $10 fees: cost, low. The secretary of state charges $10 for each transaction not otherwise provided for by law. This replaces narrower wording covering the filing of a paper. The charge can affect people and businesses using these services.
- Notary customers can face technology fees: cost, low. North Dakota notaries may charge an extra technology fee for acts under sections 44-06.1-13.1 or 44-06.1-18. The notary must have incurred technology costs to perform the act. The requester must agree in advance. The notary must explain that this charge is separate from the notarial act fee. The la…
- Employer service applications lose ID protections: cost, low. The law removes this chapter’s privacy protections for Social Security and federal tax ID numbers in professional employer organization applications. It also removes the requirement to hide those numbers before releasing an application. Audited financial reports and employers’ quarterly contributio…
