## Bill overview: provisions PRIA read

- Written buyer agreements for 1–4 homes: benefit, low. Beginning July 1, 2025, a broker who represents a buyer as a single agent for a home with one to four units must sign a written agency agreement before doing key brokerage tasks. For other property types, a written agreement is optional. The agreement must show the broker’s duties, how pay works, a…
- Wider referral fee options across borders: benefit, low. Brokers can pay a referral fee to a nonresident who is licensed where they live. They can also pay a referral fee to a citizen and resident of a foreign country that does not license this work, if the person shows reasonable proof of that status.
- More training to get and keep licenses: cost, medium. Beginning January 1, 2026, salesperson applicants must complete three commission-approved courses totaling at least 90 class hours. Online courses are allowed if the commission approves them. Also beginning January 1, 2026, new licensees must complete 12 hours of approved study within 180 days afte…
- Right-to-list home deals banned: cost, low. Licensees may not offer or enter a right-to-list home sale agreement. The real estate commission can enforce this with censure, license suspension or revocation, consent orders, and civil fines.
- Wholesaling contracts now need a license: cost, low. Nebraska now treats publicly marketing an equitable interest in a real estate purchase contract as real estate brokerage, except for vacant lots. You must hold a Nebraska real estate license to market these interests and follow all licensing rules.
- Outdated real estate statutes repealed: mixed, low. On July 1, 2025, the law repeals the old text of section 76-2422. It also repeals the prior versions of sections 81-885.02 and 81-885.24. On January 1, 2026, it repeals the old section 81-885.13. These repeals clear the way for the updated licensing and agency rules.
