Public bodies cannot run those meetings as remote-only. If a meeting is remote-only and has no physical site, the body must read clear, complete call-in instructions before th…
- Oath and defamation rules for testimony: mixed, low. If you testify under oath at a public meeting, lying is unlawful and can lead to perjury penalties. People harmed by defamatory comments made during public comment can still sue. The Open Meeting Law does not shield defamatory statements by members of the public.
- Private lawyer meetings for public bodies: mixed, low. Public bodies can meet in private with their attorney to get legal advice. This does not count as an open meeting. Any talk must be limited to legal advice on a matter within the body’s authority. This protects confidential legal advice but reduces public access to those talks.
