Listed Food Contact Approvals Ended

The FDA determined that the Food Contact Notifications (FCNs) listed in this notice are no longer effective as of January 6, 2025. If you make, supply, or use any of the specific food contact substances (FCSs listed in table 1 and table 2), those FCN authorizations no longer apply to those listed substances after that date.

Grace Period to Exhaust Existing Stocks

For the FCSs listed in table 2, FDA set a compliance date of June 30, 2025. You may continue to use existing stocks of those substances only if they were produced, supplied, or used by the manufacturer or supplier before January 6, 2025, and those stocks must be exhausted by June 30, 2025.

Right to Submit New FCNs Remains

FDA's determination that an FCN is no longer effective does not stop manufacturers or suppliers from submitting a new Food Contact Notification (FCN) for the same food contact substance and intended use after the determination. New submissions may be filed unless the use is covered by a separate food additive regulation or a threshold of regulation exemption.
