Half-Support Rule Affects Eligibility

Under Section 202(d)(4) of the Social Security Act (as applied by the Railroad Retirement Act), a child is treated as dependent only if the child receives one-half of his or her support from the stepparent. This one-half support condition affects entitlement to increases in an employee or spouse annuity and eligibility for a child's annuity as a stepchild, adopted child, grandchild, or similar categories.

Form G-139 Required for Child Annuity

If you apply for a child's annuity based on a railroad employee's support, you must complete Form G-139, Statement Regarding Contributions and Support of Children (OMB 3220-0195). The form collects financial information so the Railroad Retirement Board can compare support from the railroad employee with support from other sources, and completion is required to obtain the benefit.
