HUD Eases Rules for Proving Fair Housing Efforts Nationwide

Published Date: 3/3/2025

Rule

Summary

This update changes how HUD checks if groups are promoting fair housing. Instead of strict reports, groups just need to show they took some action to fight housing discrimination. This makes it easier and faster for communities to keep fair housing moving forward without extra paperwork or big costs.

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Easier AFFH Certification Standard

If your city, county, or housing agency gets HUD funds, they only need to show they took some action during the relevant period to promote fair housing for their AFFH certification. HUD will deem a grantee's certification sufficient if any action rationally related to eliminating housing discrimination was taken, instead of requiring stricter reports.

No Reinstatement of AI Requirement

If your city, county, or housing agency gets HUD funds, HUD is not bringing back the obligation to conduct an 'Analysis of Impediments' or requiring any specific fair housing planning mechanism. Program participants must still affirmatively further fair housing as required by the Fair Housing Act, but they are not mandated to use a specific planning process.
