Time's Up: Request Antidumping Duty Reviews Before Deadlines Hit

If you’re involved in importing goods that might be subject to special U.S. taxes called antidumping or countervailing duties, now’s your chance to ask for a review or join the annual update list. The Department of Commerce is opening a window to request reviews and will pick which companies to check based on import data, so get your paperwork in quickly! Request Administrative Review by March Deadline

If you are an interested party (importer, exporter, or other party) in any listed antidumping (AD) or countervailing duty (CVD) proceeding, you may request an administrative review not later than the last day of March 2025 (or the next business day if that date is a weekend or federal holiday). The notice lists specific orders and the period of review for each (for example, many AD proceedings list 3/1/24–2/28/25 or CVD proceedings list 1/1/24–12/31/24).

No Request Means Duties Assessed At Cash Deposit Rate

If Commerce does not receive a request for review of the listed order entries by the last day of March 2025, Commerce will instruct U.S. Customs and Border Protection to assess antidumping or countervailing duties on those entries at a rate equal to the cash deposit required at time of entry, and to continue collecting that cash deposit.

Respondent Selection Uses CBP Data — Quick Timelines

If Commerce limits the number of respondents in a review, it intends to select respondents based on U.S. Customs and Border Protection (CBP) import data for the period of review. Commerce will release CBP data under an Administrative Protective Order to parties with APOs within five days of the initiation notice and will make respondent selection decisions within 35 days of the initiation Federal Register notice. Parties are encouraged to file APO applications promptly and may comment on respondent selection within five days of CBP data placement.

Particular Market Situation Allegations: 20‑Day Deadline

If an interested party wishes to submit a particular market situation (PMS) allegation and supporting factual information under section 773(e) of the Act, the submission must be filed no later than 20 days after submission of initial Section D responses. If Commerce finds a PMS exists, it will modify its dumping calculations appropriately.

Non‑Market Economy (NME) Entity Treatment in Reviews

Commerce will not consider the non‑market economy (NME) entity as an exporter conditionally subject to an AD administrative review; the NME entity will not be under review unless Commerce specifically receives a request for, or self‑initiates, a review of the NME entity. If an individual exporter in a review does not qualify for a separate rate, Commerce will determine that the exporter is part of the NME entity and will instruct CBP to liquidate entries for exporters not named in the initiation notice.

Annual Inquiry Service List — 30‑Day Update Window

Commerce will update annual inquiry service lists for the listed orders and suspended investigations; interested parties have 30 days after the date of this notice to submit new or amended entries of appearance to be included on the updated lists. Commerce will finalize the lists five business days after that 30‑day window. Petitioners and foreign governments that submitted an entry of appearance once will be automatically added to updated lists in following years but remain responsible for any amendments.

Electronic Filing and Service Requirement via ACCESS

All requests for administrative review must be filed electronically in Enforcement and Compliance's ACCESS system (https://access.trade.gov), and a copy of each request must be served on the petitioner and each exporter or producer specified in the request per 19 CFR 351.303(f)(1)(i).
