Notice
Summary
Training & Readiness Accelerator II (TReX II) just added a bunch of new members from all over the U.S., including companies and universities. This update keeps their special legal protections against big antitrust lawsuits in place, so they can keep working together smoothly. These changes took effect in early February 2025 and help the group keep innovating without costly legal distractions.
Analyzed Economic Effects
2 provisions identified: 1 benefits, 1 costs, 0 mixed.
Antitrust Damage Cap Extended
On February 7, 2025, Training & Readiness Accelerator II (TReX II) filed notifications to extend the protections of the National Cooperative Research and Production Act of 1993 that limit antitrust plaintiffs to recovering only actual damages under specified circumstances. The notice names many companies and universities that were added as parties (see notice for the full list), and it states membership in the project remains open.
Listed Members Withdrew From Venture
The notice (filed February 7, 2025) lists specific entities that have withdrawn as parties to TReX II (for example, Exyn Technologies, Inc., Philadelphia, PA; Bell Textron, Inc., Fort Worth, TX; and others). Those withdrawn entities are no longer parties to the venture and thus are not covered by the Act's protections as described in this filing.
