The U.S. Commerce Department checked two Mexican sugar companies to see if they followed the rules about fair pricing from Dec 2022 to Nov 2023. One company, San Jose, had no sales to review, but Grupo BSM didn’t cut their unfair pricing enough. Commerce preliminarily determined that Santa Rosalia de la Chontalpa and its affiliates (Grupo BSM) did not eliminate at least 85 percent of the dumping required during the period December 1, 2022 through November 30, 2023. Commerce considers Grupo BSM's behavior serious and says it will implement steps to address the noncompliance.
San Jose had no attributable sales to review
Commerce preliminarily determined that Azucarera San Jose De Abajo S.A. (San Jose) had no attributable sales to serve as a basis for reviewing compliance under the Agreement during December 1, 2022 through November 30, 2023. As a result, Commerce made no compliance finding for San Jose for that period.
Agreement meets statutory requirements for review period
Commerce preliminarily determined that the Agreement Suspending the Antidumping Duty Investigation on Sugar from Mexico met the applicable statutory requirements during the period December 1, 2022 through November 30, 2023. Commerce therefore preliminarily finds the Agreement remained legally sufficient for that review period.
