Farmers Must Clean Up, Pay Penalty
The United States and the Commonwealth of Virginia lodged a proposed Consent Decree requiring Frazier T. Boyd III and Boyd Farm LLC to restore impacted areas, perform mitigation, and pay a civil penalty for discharging pollutants without a permit under Section 301(a) of the Clean Water Act (33 U.S.C. 1311(a)) and Virginia law (Va. Code Sec. 62.1-44.5(A)(2)-(4)). The decree resolves the Governments' claims and imposes these obligations on the named defendants.
Public Has 30-Day Comment Window
The Department of Justice will accept written comments on the proposed Consent Decree for thirty (30) days from the date of publication, beginning April 23, 2025 and running through May 23, 2025. Anyone may submit comments by mail or email to the Environment and Natural Resources Division referencing United States v. Boyd, DJ No. 90-5-1-1-22125.
