Opportunity Knocks: Request Antidumping Duty Reviews Now or Forever Hold Peace

If No Review Requested, Duties Assessed At Cash Deposit Rate

If Commerce does not receive a request for review for the listed orders by the last day of May 2025, Commerce will tell U.S. Customs and Border Protection (CBP) to assess antidumping or countervailing duties on those entries at a rate equal to the cash deposit required at the time of entry, and to continue collecting the previously ordered cash deposit.

Deadline to Request Administrative Review

If you are an interested party (importer, exporter, or producer) you may ask Commerce to conduct an administrative review of listed antidumping or countervailing duty orders. Requests for the orders listed in this notice must be received not later than the last day of May 2025 (or the next business day if that date falls on a weekend or holiday).

Respondent Selection Uses CBP Data; APO Timing

If Commerce limits the number of respondents for individual examination, it will select respondents using U.S. Customs and Border Protection (CBP) import data for the period of review. Commerce intends to release that CBP data under an Administrative Protective Order to parties with an APO within five days of the initiation notice and to decide on respondent selection within 35 days of that notice. Parties are encouraged to submit APO applications on the date of publication of the initiation notice and may comment on respondent selection within five days after the CBP data is placed on the record.

Particular Market Situation (PMS) Filing Deadline

If you want to submit a Particular Market Situation (PMS) allegation under section 773(e) to affect constructed value calculations, you must submit the PMS allegation and supporting new factual information no later than 20 days after submission of initial Section D responses.

Nonmarket Economy (NME) Entity Review Rule

Commerce will not treat the nonmarket economy (NME) entity as automatically under administrative review; the NME entity will only be under review if Commerce specifically receives a request for, or self-initiates, a review of the NME entity. If no review of the NME entity is conducted, the NME entity's rate will not change as a result of that review and Commerce will instruct CBP to liquidate entries for exporters not named in the initiation notice at the applicable rates.

90-Day Window To Withdraw Review Requests

A party that requests an administrative review may withdraw that request within 90 days of the date of publication of the notice of initiation of the requested review, and Commerce may extend this 90-day period on a case-by-case basis if reasonable.

Annual Inquiry Service List Update Window

Commerce will update annual inquiry service lists for the listed proceedings; interested parties have 30 days after the date of this notice to submit new or amended entries of appearance for inclusion, and Commerce will finalize the lists five business days after that 30-day period. Petitioners and foreign governments that have submitted an entry of appearance once will be automatically added to the updated list in future years.
