Importers: Request Duty Reviews Before Deadlines Hit

Summary

If you’re involved in importing goods that might be subject to special taxes called antidumping or countervailing duties, now’s your chance to ask the government to review those taxes. This notice tells importers and companies how to request reviews, join a yearly update list, and comment on who gets picked for detailed checks. Act fast—deadlines and data sharing happen soon, and your input could affect money and trade rules.

Deadline to Request Review or Face Duty Rate

If you import any of the listed products, you (or another interested party) must request an administrative review not later than the last day of June 2025. If Commerce does not receive a request by that date, U.S. Customs and Border Protection will be instructed to assess antidumping or countervailing duties on those entries at a rate equal to the cash deposit required at entry and to continue collecting that cash deposit.

Deadline for Particular Market Situation Allegations

If you want Commerce to consider a particular market situation (PMS) under section 773(e) of the Tariff Act for constructed value, you must submit the PMS allegation and supporting factual information no later than 20 days after submission of initial Section D responses so Commerce has time to consider it; if Commerce finds a PMS exists, it will modify dumping calculations accordingly.

Nonmarket-Economy (NME) Entity Review Rule

Commerce stated it no longer considers the NME entity conditionally subject to an AD administrative review; the NME entity will not be under review unless Commerce receives a request or self-initiates a review of the NME entity, and if no review of the NME entity is conducted, the NME entity's rate will not change as a result of that review while CBP will be instructed to liquidate entries for exporters not named in the initiation notice.

Respondent Selection: CBP Data, APO Timing

If Commerce limits the number of respondents for individual examination, it will select respondents using CBP import data for the period of review, release that CBP data under Administrative Protective Order to parties with an APO within five days of the initiation notice, and make respondent-selection decisions within 35 days of the initiation Federal Register notice. Parties wanting to comment should submit APO applications promptly and may comment within five days after the CBP data are placed on the record.

90-Day Withdrawal Window for Review Requests

A party that requests an administrative review may withdraw that request within 90 days of the date of publication of the notice of initiation of that requested review; Commerce may extend the 90-day period if it finds an extension reasonable on a case-by-case basis.

Annual Inquiry Service List Update Window

Commerce will update annual inquiry service lists for the listed orders and suspended investigations and requires interested parties to submit a new or amended entry of appearance within 30 days after the date of this notice to appear on the updated list; Commerce will finalize the lists five business days after that 30-day period.
