Summary

The U.S. is taking a closer look at hard empty capsules coming from Brazil, China, India, and Vietnam to see if they're hurting American businesses by being unfairly cheap or subsidized. This final review will decide if extra taxes (duties) should be added to these imports to protect U.S. companies. The investigation is moving forward now, so importers and manufacturers should pay attention to possible changes soon.

Imports under final trade review

The U.S. International Trade Commission has scheduled the final phase of antidumping and countervailing duty investigations into hard empty capsules from Brazil, China, India, and Vietnam (investigation Nos. 701-TA-742-745 and 731-TA-1720-1723). The products are provided for in HTSUS subheadings 9602.00.10 and 9602.00.50 and were preliminarily determined by the Department of Commerce to be subsidized and sold at less-than-fair-value.

Potential protection for U.S. capsule makers

The final-phase investigation will determine whether imports of hard empty capsules from Brazil, China, India, and Vietnam are materially injuring or threatening U.S. producers or retarding establishment of a U.S. industry. If the Commission finds injury, that finding is part of the process that can lead to measures intended to protect U.S. manufacturers.
